- What kinds of workers’ compensation benefits can I receive?
If you have been injured at work, you are entitled to two-thirds of your average weekly wage. These are temporary benefits that you will receive while you are unable to work. Once released by a doctor, you may be entitled to additional permanent benefits. Both temporary and permanent payments are capped at a certain level by law. In addition, your employer is responsible for covering the costs of your medical expenses. If you have lost a loved one in a workplace accident, you are entitled to death benefits and burial expenses.
- Can I be fired for making a workers’ comp claim?
No. It is against the law to fire someone for making a workers’ compensation claim. If you are terminated for filing a workers’ comp claim, you have a separate legal claim.
- Do I get to choose my doctor?
You must go to a doctor selected by your employer. If you are not satisfied with this doctor and you need additional treatment, you can select another doctor from a panel of doctors. There are additional exceptions to this law, which we can explain to you.
- Do I really need an attorney to handle my workers’ comp claim?
An attorney may not be necessary in every case. With that said, many employers may try to downplay your injuries or claim that your injuries were not related to work. In addition, if someone other than your employer caused your injuries, you may be eligible to recover additional damages in a personal injury claim. It never hurts to discuss your case with a lawyer.
- What if I cannot afford a lawyer?
